Citizenship Act
Section 9.006 — Citizenship by option; requirements; process; approval and denial of applications; provide for.
(1) A person who is not otherwise a citizen by birth under another provision of this act may, by the process prescribed in subsection (2), acquire citizenship by option if any of the following apply:
(a) The person is an adult and has a parent, adoptive parent, or grandparent who is or was an Eniarkian citizen.
(b) The person is a minor of at least 12 years of age and has a parent, adoptive parent, or grandparent who is or was an Eniarkian citizen.
(c) The person is a parent of an Eniarkian minor.
(d) The person has entered into a valid marriage to an Eniarkian citizen.
(e) The person is an adult who became domiciled in Eniarku or its territories as a minor.
(f) The person has completed not less than 6 months of voluntary service in the Eniarkian armed forces.
(2) A person may acquire citizenship by option by submitting a declaration in a form prescribed by the Lord High Chancellor The declaration must include, but is not limited to, an attestation that the declarant satisfies one or more of the eligibility requirements in subsection (1) and a statement that any of the following will result in the declaration being voided and the declarant being barred from future acquisition of citizenship by option:
(a) The declarant knowingly makes false statements under oath or submits false statements under attestation during the declaration process.
(b) The declarant knowingly withholds or conceals pertinent information in the declaration for citizenship by option.
(c) The declarant knowingly engages in fraudulent actions during the declaration process.
(3) The Lord High Chancellor shall review a declaration submitted under subsection (2) with all deliberate speed and shall grant citizenship by option to the declarant subject to subsection (4) and any other applicable law.
(4) The Lord High Chancellor shall deny a declaration submitted under subsection (2) if, upon thorough review of the declaration, the Lord High Chancellor determines, based on clear and convincing evidence, that one or more of the following apply:
(a) The declarant does not satisfy all of the eligibility requirements in subsection (1).
(b) The declaration is found to contain false statements made under oath or submitted under attestation during the declaration process.
(c) The declarant is found to have knowingly withheld or concealed pertinent information on the declaration
(d) The declarant is found to have knowingly engaged in fraudulent actions during the declaration process.
