Citizenship

The requirements for Eniarkian citizenship are set in statute by the Citizenship Act, 2026 AS 8 and other implementing legislation. Like many European, Asian, and African states, the grand duchy does not automatically grant citizenship simply because a person is born within its territory — a practice known as jus soli (“right of soil”) citizenship — but instead, generally follows the principles of jus sanguinis (“right of blood”) citizenship, under which a child’s citizenship at birth is determined primarily by whether one or both of the parents are citizens.

The government also administers processes for applying for citizenship by naturalization and, in unique circumstances, claiming citizenship by option. Citizenship at birth

Under ECL 9.004, a person is automatically granted Eniarkian citizenship at birth if any of the following apply:

  • The person is born to parents, both of whom are citizens, irrespective of the place of birth or the marital status of the parents.
  • The person is born in Eniarku or its territories to parents, one of whom is a citizen who maintains a permanent residence in Eniarku or its territories at the time of the birth of such person, and the other of whom is an alien.
  • The person is born outside of Eniarku and its territories to parents, one of whom is a citizen who maintains a permanent residence in Eniarku or its territories at the time of the birth of such person, and the other of whom is an alien.
  • The person is born in Eniarku or its territories to parents, both of whom are stateless or otherwise unable to pass on their nationality or citizenship.

Citizenship by naturalization

A foreign national, also known as an “alien,” may become a citizen of Eniarku by naturalization under ECL 9.005. In order to apply for naturalization, all of the following must apply:

  • The person must be an adult (18 years of age or older).
  • The person has not had previously their Eniarkian citizenship revoked.
  • The person has not previously been convicted of a felony under Eniarkian law or the laws of another country.

Citizenship by option

In certain circumstances, a person may claim Eniarkian citizenship by virtue of a “secondary” status, which under ECL 9.006 applies in any of the following circumstances:

  • The person is an adult and has a parent, adoptive parent, or grandparent who is or was an Eniarkian citizen.
  • The person is a minor of at least 12 years of age and has a parent, adoptive parent, or grandparent who is or was an Eniarkian citizen.
  • The person is a parent of an Eniarkian minor.
  • The person has entered into a valid marriage to an Eniarkian citizen.
  • The person is an adult who became domiciled in Eniarku or its territories as a minor.
  • The person has completed not less than 6 months of voluntary service in the Eniarkian armed forces.

Citizenship by default

Under ECL 9.007, the grand duke is authorized to grant citizenship “by default” to persons who are related to him within three degrees of consanguinity (kinship), which applies primarily to the immediate royal family.

Renunciation and Loss of Citizenship

Pursuant to ECL 9.008 and 9.009, a person who is an Eniarkian citizen by birth is forever entitled to that status unless they renounce their citizenship, subject to the following requirements:

  • The citizen is is an adult.
  • The citizen is not the subject of a pending or ongoing legal proceeding in Eniarku.
  • The citizen is of sound mind and is not subject to duress or external coercion.
  • The citizen would not be rendered stateless by renouncing their Eniarkian citizenship.

Similarly, naturalized citizens (as well as individuals who have claimed citizenship by option) may also renounce their citizenship if they satisfy all of the above requirements. Citizens who wish to renounce their citizenship voluntarily may do so by submitting Form RC-900: Declaration of Renunciation of Citizenship (form opens in a new tab).

Importantly, naturalized citizens automatically forfeit their Eniarkian citizenship if any of the following apply:

  • The citizen acquires citizenship of two or more foreign micronations.
  • The citizen performs military service on behalf of another micronation without the prior approval of the government.
  • The citizen is deemed to have harmed or threatened the security of the state.
