A resolution for an ACT OF STATE to provide for nationality and citizenship of the Grand Duchy of Eniarku; and to provide for the related powers and duties of the government.

BE IT ENACTED BY THE CROWN-IN-COUNCIL:

Sec. 9.001. This act may be cited as the "Citizenship Act".

Sec. 9.002. As used in this act:

(a) "Adult" means a person who is 18 years of age or older.

(b) "Alien" means a person who is a foreign national or a foreign citizen that does not hold Eniarkian citizenship.

(c) "Citizen" means a person to whom the government has granted the full rights, obligations, and protections due to a member of a state, whether at birth, by naturalization, or by option.

(d) "Minor" means a person who is less than 18 years of age.

(e) "National" means a person who, by birth, naturalization, or another process, owes permanent allegiance to a state.

Sec. 9.003. Subject to this act, a person born in Eniarku or its territories shall not be entitled to jus soli citizenship.

Sec. 9.004. A person shall be a national and a citizen at birth if any of the following apply:

(a) The person is born to parents, both of whom are citizens, irrespective of the place of birth or the marital status of the parents.

(b) The person is born in Eniarku or its territories to parents, one of whom is a citizen who maintains a permanent residence in Eniarku or its territories at the time of the birth of such person, and the other of whom is an alien.

(c) The person is born outside of Eniarku and its territories to parents, one of whom is a citizen who maintains a permanent residence in Eniarku or its territories at the time of the birth of such person, and the other of whom is an alien.

(d) The person is born in Eniarku or its territories to parents, both of whom are stateless or otherwise unable to pass on their nationality or citizenship.

Sec. 9.005. (1) An alien that satisfies all of the following conditions may, by the process prescribed in subsection (2), apply to obtain citizenship by naturalization:

(a) The alien is an adult.

(b) The alien has not been the subject of an order revoking their citizenship.

(c) The alien has not been previously been convicted of a felony under the laws of the state or a similar law of another state.

(2) An alien may acquire citizenship by naturalization by submitting an application in a form prescribed by the Lord High Chancellor The application must include, but is not limited to, an attestation that the applicant satisfies all of the eligibility requirements in subsection (1) and a statement that any of the following will result in the application being voided and denied:

(a) The applicant knowingly makes false statements under oath or submits false statements under attestation during the naturalization process.

(b) The applicant knowingly withholds or conceals pertinent information on the application for citizenship by naturalization.

(c) The applicant knowingly engages in fraudulent actions during the naturalization process.

(3) The Lord High Chancellor shall review an application submitted under subsection (2) with all deliberate speed and shall approve the application subject to subsection (4) and any other applicable law.

(4) The Lord High Chancellor shall deny an application submitted under subsection (2) if, upon thorough review of the application, the Lord High Chancellor determines, based on clear and convincing evidence, that one or more of the following apply:

(a) The applicant does not satisfy all of the eligibility requirements in subsection (1).

(b) The application is found to contain false statements made under oath or submitted under attestation during the naturalization process.

(c) The applicant is found to have knowingly withheld or concealed pertinent information on the application.

(d) The applicant is found to have knowingly engaged in fraudulent actions during the naturalization process.

Sec. 9.006. (1) A person who is not otherwise a citizen by birth under another provision of this act may, by the process prescribed in subsection (2), acquire citizenship by option if any of the following apply:

(a) The person is an adult and has a parent, adoptive parent, or grandparent who is or was an Eniarkian citizen.

(b) The person is a minor of at least 12 years of age and has a parent, adoptive parent, or grandparent who is or was an Eniarkian citizen.

(c) The person is a parent of an Eniarkian minor.

(d) The person has entered into a valid marriage to an Eniarkian citizen.

(e) The person is an adult who became domiciled in Eniarku or its territories as a minor.

(f) The person has completed not less than 6 months of voluntary service in the Eniarkian armed forces.

(2) A person may acquire citizenship by option by submitting a declaration in a form prescribed by the Lord High Chancellor The declaration must include, but is not limited to, an attestation that the declarant satisfies one or more of the eligibility requirements in subsection (1) and a statement that any of the following will result in the declaration being voided and the declarant being barred from future acquisition of citizenship by option:

(a) The declarant knowingly makes false statements under oath or submits false statements under attestation during the declaration process.

(b) The declarant knowingly withholds or conceals pertinent information in the declaration for citizenship by option.

(c) The declarant knowingly engages in fraudulent actions during the declaration process.

(3) The Lord High Chancellor shall review a declaration submitted under subsection (2) with all deliberate speed and shall grant citizenship by option to the declarant subject to subsection (4) and any other applicable law.

(4) The Lord High Chancellor shall deny a declaration submitted under subsection (2) if, upon thorough review of the declaration, the Lord High Chancellor determines, based on clear and convincing evidence, that one or more of the following apply:

(a) The declarant does not satisfy all of the eligibility requirements in subsection (1).

(b) The declaration is found to contain false statements made under oath or submitted under attestation during the declaration process.

(c) The declarant is found to have knowingly withheld or concealed pertinent information on the declaration

(d) The declarant is found to have knowingly engaged in fraudulent actions during the declaration process.

Sec. 9.007. The sovereign may, by letters patent or other instrument authorized by law, grant citizenship by default to a person who is related, by blood or by marriage, to the sovereign within the third degree of consanguinity.

Sec. 9.008. (1) A citizen that satisfies all of the following conditions may, by the process prescribed in subsection (2), apply to renounce their citizenship:

(a) The citizen is an adult.

(b) The citizen is not the subject of a pending or ongoing legal proceeding in Eniarku.

(c) The citizen is of sound mind and is not subject to duress or external coercion.

(d) The citizen would not be rendered stateless by renouncing their Eniarkian citizenship.

(2) A citizen may renounce their citizenship at any time by submitting a declaration in a form prescribed by the Lord High Chancellor The declaration must include, but is not limited to, an attestation of all of the following:

(a) The declarant is an adult.

(b) The declarant is not the subject of a pending or ongoing legal proceeding in Eniarku.

(c) The declarant is of sound mind and is not subject to duress or external coercion.

(d) The declarant will not be rendered stateless by renouncing their Eniarkian citizenship.

(e) The declarant no longer wishes to remain an Eniarkian citizen.

(f) The declarant understands that, upon approval of the declaration, they will no longer be entitled to the rights, obligations, and protections due to a member of a state.

(3) The Lord High Chancellor shall review a declaration submitted under subsection (2) with all deliberate speed and shall grant the renunciation of citizenship request to the declarant subject to subsection (4) and any other applicable law.

(4) The Lord High Chancellor shall deny a declaration submitted under subsection (2) if, upon thorough review of the declaration, the Lord High Chancellor determines, based on clear and convincing evidence, the declarant knowingly made a false attestation of any item required under subsection (2).

(5) A person who renounces their citizenship under this section shall be ineligible to reapply for citizenship for a period of not less than 1 year.

Sec. 9.009. (1) A person who is a citizen under ECL 9.004 shall forever be entitled to that status unless they renounce their citizenship under ECL 9.007.

(2) A person who is a naturalized citizen under ECL 9.005 shall forfeit that status only if any of the following apply:

(a) The naturalized citizen renounces their citizenship under ECL 9.007.

(b) The naturalized citizen acquires citizenship of 2 or more foreign micronational states.

(c) The naturalized citizen performs military service on behalf of a foreign micronational state without the prior authorization of the government.

(d) The naturalized citizen is deemed to have harmed or threatened to harm the internal or external security of the state.

(3) The Lord High Chancellor, upon making a determination that a naturalized citizen has forfeited their citizenship status under paragraph (2)(b), (2)(c), or (2)(d), shall issue a denaturalization order formally revoking the naturalized citizen's citizenship status. The Lord High Chancellor shall transmit a denaturalization order issued under this subsection directly to the naturalized citizen as soon as practicable. A denaturalization order issued under this subsection is final and is not subject to appeal.

(4) A person who is a citizen by option under ECL 9.006 shall be treated as a citizen by birth for the purposes of this section, pursuant to ECL 9.004.
